General Terms & Conditions of Entry to Active Run Events

1.   DEFINITIONS

In these Conditions the following definitions shall apply:

“Active Run”, “we” or “us” means Active Run, a trading name of InEvent Branding Limited, a company incorporated in England and Wales with company number: 9375486,    

“Agreement” means the agreement between you and us, comprising these Conditions and the Event Conditions;

“Event” means any event organised by us for which you have registered as a participant;

“Event Conditions” means any terms or conditions that we may notify to you from time to time, in addition to these Conditions, in relation to a particular Event;

“Registration Fee” means the fee payable by you in consideration of your participation in an Event;

2.   ENTRY

2.1   By submitting your application for registration in an Event and paying your Registration Fee you are agreeing to comply with the terms of the Agreement and any instructions given to you by organisers or event officials in relation to the Event.

2.2  Participants in any Event are subject to the competition rules as provided by the relevant governing body.  In the event of any conflict the terms of the Agreement shall prevail.

3.   PARTICIANT INFORMATION AND CHANGE OF DETAILS

3.1  When you register for an Event you will be asked to provide your personal information and contact details.  Please ensure that this is correct.

3.2  We will notify you of your start time, race number and other relevant information bv email and/or post so it is vital that we have your correct contact information.  If you change your postal or email address after your registration for an Event then please let us know as soon as possible by emailing contact@activerun.co.uk or by post to Active Run, Fairburn House, Green Lane, Garforth, LS25 2AF.

3.3  We accept no responsibility for any loss or damage for any failure to provide correct information or to comply with Condition 3.1 above.

4.   EVENT SAFETY

4.1  For the safety of yourself and others you must adhere to the instructions of Event staff and officials at all times during the Event.

4.2  You are not permitted to use the following during an Event:

4.2.1  any wheeled device, including without limitation, cycles, roller skates or motorised or electric wheelchairs, save that self-propelled wheelchairs will be permitted if you entered the wheelchair section of the Event;

4.2.2  any artificial aid or assistance;

4.2.3  any pets or animals; or

4.2.4  any other item which could potentially affect the safety or inhibit the flow of participants or which in our opinion could cause risk or danger to you or other participants.

4.3  It is your responsibility to ensure that you have the appropriate footwear, clothing and equipment taking into account the location, time of year and forecast weather conditions for an Event.

5.   EVENT CONDUCT

5.1  Your registration for and participation in an Event is personal to you.You are expressly prohibited from transferring, swapping or selling your place in an Event or allowing anyone else to wear your race number or participate in your place.

5.2  By arriving at an Event you warrant that on the Event date you are sufficiently fit and healthy to participate in the Event unaided and in accordance with the Agreement.  If you are in any doubt you should seek medical advice prior to the Event.

5.3  All participants must display a valid running number at all times.  Only registered participants are allowed into the start and finish areas or to use the Event resources.

6.   EJECTION FROM AN EVENT

6.1  We reserve the right to refuse admission to an Event or require you to leave an Event if:

6.1.1  you fail to follow any instructions given by Event officials or staff;

6.1.2  we consider that you are unfit to participate in the Event for any reason including as a result of alcohol, drugs, injury or illness;

6.1.3  you fail to arrive at the start location at the specified time;

6.1.4  you attempt to participate in the Event in a manner which, in our opinion:

a) could cause injury to yourself, another participant or any other person;

b) is likely to cause offence, is disruptive or may adversely impact on the Event experience of others;

c) may damage or harm the environment or any property;

d) may otherwise pose any risk to the health and safety of any other person;

6.1.5  you are unable to make sufficient progress in the Event to enable you to complete the Event within the timelines notified to you by Event officials.

6.2  We reserve the right to refuse entry to an Event for any person at our sole discretion.

7.   CANCELLATION BY YOU

7.1  You should notify us by email as soon as possible if you wish to withdraw from an Event for any reason.  By registering for an Event you have obtained one of a limited number of places.  If you notify us that you wish to withdraw from the Event more than 30 clear days prior to the Event then we will refund your Registration Fee, less a small administration charge.  If you notify us after this time then, unfortunately, we will not be able to offer a refund.

8.   CANCELLATION BY US

8.1  We are under no obligation to hold any Event and may cancel any Event or your participation in an Event for any reason.

8.2  We may also cancel an Event in circumstances beyond our control including, but not limited to, weather conditions, venue availability, local restrictions, civil unrest, war or terrorism.

8.3  If we cancel an Event we will give you as much notice as we are reasonably able taking into account the reasons for such cancellation.  In such circumstances:

8.3.1  we will endeavour to hold the Event at a later date at the same or an alternative venue and information regarding this will be communicated to you as soon as reasonably practicable;

8.3.2  you will be entitled to take part in the re-arranged Event; and

8.3.3  if you are unable to take part in the re-arranged Event or we determine that it is not possible to re-arrange the Event we will refund your Registration Fee.

8.4  If an Event is cancelled or re-arranged we accept no responsibility for any costs incurred by you including travel and accommodation costs.

9.   CHANGES TO AN EVENT

9.1  We reserve the right to make any changes to the course or other changes to the Event that we consider necessary or desirable.  We will notify you of any changes as soon as practicable or when you arrive at the Event.

9.2  We will not be liable to offer you any refund as a result of any changes to an Event unless such change materially alters the nature of the Event.

10.  USE OF IMAGE

10.1   It is likely that an Event will be photographed for promotional purposes.By registering for an Event you consent to our photographic capture of your participation in the Event and publication of such photograph by us in any way that we see fit.

11.  LIABILITY

11.1  In no event shall we be liable to you, whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Agreement for any:

11.1.1  loss or damage;

11.1.2  loss of profit;

11.1.3  loss of reputation;

11.1.4  loss of business, revenue or goodwill;

11.1.5  loss of anticipated savings;

11.1.6  pledges made on your behalf or by you to charity; or

11.1.7  consequential or indirect loss, regardless of whether the loss or damage was reasonably foreseeable.

11.2  Nothing in the Agreement shall affect our liability for death or personal injury, fraud, or any other liability to the extent it cannot be excluded or limited by law.

11.3  We shall procure and maintain appropriate third party liability insurance for the Event for our own benefit. You:

11.3.1  acknowledge that you are not entitled to benefit under such insurance where any claim is made against you by a third party for death, personal injury or damage to property arising out of or in connection with your negligent actions or omissions whilst participating in the Event; and

11.3.2  shall indemnify us and keep us indemnified against any claim made against us by a third party for death, personal injury or damage to property arising out of or in connection with your negligent actions or omissions whilst participating in the Event.

12.   GENERAL

12.1  If any of term or provision of the Agreement is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

12.2  These Conditions, the Event Conditions and any document expressly referred to in them represent the entire agreement between you and us in relation to an Event and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

12.3  If there is any conflict or inconsistency between any provisions contained in these Conditions and any provision in the Event Conditions then, unless expressly stated otherwise, the Event Conditions shall prevail.

12.4  You acknowledge that, in registering for an Event, you have not relied on any representation, undertaking or promise given by us or implied from anything said or written by us prior to such registration except as expressly stated in these Conditions.

12.5  We have the right to revise and amend these Conditions from time to time.

12.6  The Agreement is between you and us. No other person has any rights to enforce any of its terms.

12.7  The Agreement is governed by the laws of England and Wales. Any dispute arising from, or related to, such Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales
